By accessing or using CornerstonePlus (the Service), you agree to be bound by these Terms of Use and our Privacy Policy.

1. Terms of Use

1.1 About the Service

CornerstonePlus is an online tool that provides access to planning and property-related information for selected local government areas in Queensland. It is intended to assist users to understand planning and building constraints relevant to a property. It does not replace formal advice from local councils, certifiers or other professionals.

1.2 Who these terms apply to

These Terms of Use apply to all users of the Service, including property owners, builders, designers, consultants, and members of the public who access the Service. If you use the Service on behalf of a business or organisation, you represent that you are authorised to accept these Terms on its behalf.

1.3 Acceptance of terms

By accessing or using the Service, you agree to these Terms. If you do not agree with these Terms, you must not use the Service.

1.4 No legal, planning or building advice

The information provided through the Service is general in nature and is for information purposes only. It does not constitute:

• legal or financial advice;
• town planning advice; or
• building or engineering certification, approval or compliance advice.

You should obtain your own independent advice from qualified professionals and confirm all information with the relevant local government or authority before making any decision or taking any action based on the information displayed.

1.5 Accuracy and availability of information

We aim to provide accurate and up-to-date information, but we do not guarantee that any information displayed through the Service is complete, current, error-free or suitable for your particular purpose. Mapping layers and data may be sourced from third parties (including local councils and government agencies) and may change without notice.

The Service may be unavailable from time to time due to maintenance, technical issues or factors outside our control. We do not guarantee continuous or uninterrupted access to the Service.

When using the Service, you must:

• use the Service only for lawful purposes;
• comply with all applicable laws and regulations, including planning and building laws;
• ensure that any information you provide through the Service is accurate and not misleading;
• not attempt to circumvent security or access controls; and

1.7 Intellectual property

Unless otherwise stated, we own or license all copyright and other intellectual property rights in the Service and its content (including text, graphics, logos, interface design and software). Some mapping data and imagery may be owned by third parties and used under licence or with permission.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your internal business or personal purposes. You must not, without our prior written consent (or the consent of the relevant rights holder):

• copy, reproduce, modify or adapt any part of the Service or its content except as permitted by law;

The Service may contain links to third-party websites or services (including council websites and our Request a Quote portal). Those websites and services are operated by third parties and are not under our control. We are not responsible for their content, availability, privacy practices or terms of use. To the maximum extent permitted by law, we exclude all warranties, guarantees and representations (whether express or implied) relating to the Service, including any implied warranties of accuracy, completeness, fitness for a particular purpose or non-infringement.

Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law or other legislation that cannot lawfully be excluded or limited.

1.10 Limitation of liability

To the maximum extent permitted by law, Cornerstone and its directors, employees, contractors and agents are not liable for any loss, damage, cost or expense (including indirect or consequential loss, loss of profits, loss of opportunity or loss of data) arising out of or in connection with:

• your use of, or inability to use, the Service; or
• your reliance on any information obtained through the Service,

even if we have been advised of the possibility of such loss or damage.

If our liability cannot be excluded but can be limited, our liability to you is limited to the resupply of the Service or the cost of resupplying the Service.

1.11 Indemnity

You agree to indemnify and hold harmless Cornerstone and its directors, employees, contractors and agents from and against any claims, liabilities, losses, damages, costs and expenses arising out of or in connection with:

• your use of the Service; or
• your breach of these Terms.

We may update the Service and these Terms from time to time. The updated Terms will be posted on this page with a new Last updated date. By continuing to use the Service after changes are made, you accept the updated Terms.

1.13 Governing law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and any courts that may hear appeals from those courts.

If you access our separate Request a Quote or contact forms, we may collect additional information as described on those forms (for example, applicant, owner and builder details, and project information).

• enter property details or other information into the mapping interface;
• request a quote or submit an enquiry through our website or related portals; or
• contact us by phone, email or in person.

We collect, use and disclose personal information as reasonably necessary for our functions and activities, including to:

• provide, operate and improve the Service and our building certification services;
